paying for day camp when kids aren't there

My ex is billing me for daycare (summer daycamp at the YMCA) and I found out the kids aren't even going on all the days she's billing me for. For all I know she's getting a refund. The question is, do I pay or not? I don't want to be in contempt. CS order says I pay a percentage of summer programs, but if they aren't there why would I pay? Thanks for any advice.

call the YMCA and start paying half directly to them....or get a receipt from them directly. Show them the court order of you paying half and they should not give you too hard of a time...See if they will give you their attendance record too and put it with your files.

aren't there.  If she has signed them up so she can work, it's still legit.  On the other hand, some of them have you pay only half or can pro-rate it.  Is there a way to verify the charges?

I agree.  Get the statements from the YMCA and the attendance records.  Pay the YMCA directly.  Pro-rate if neccessary and bill her for any days you paid for and the children were not in attendance.  Feel free to add simple interest and a due date then late fees.  The YMCA will normally support your endeavors since they are normally all about the kids.

I have to pay for daycare regardless if the kids are there or not.  You're paying for them to hold an opening for the child should you need to bring them.

I would contact the center and verify thier enrollment and find out what their policy is about being absent.  If their policy is that you pay regardless, then I would set it up to pay them directly.  You cannot be found in contempt because you are fulfilling the requirement of paying for a portion of the child care costs.

The responses and opinions are different depending on if the government orders a person to pay or provides for a person to collect.

If you re-read the OP post the payer is ACCOUNTABLE, fears being punished, but has no problem providing for something that benefits his children.

On the other hand, the collector is UNACCOUNTABLE , fears nothing,  does what SHE damn pleases, and may be using the children to fraud the payer while teaching irresponsibilty.

a TX day care center was closed today because the adults had no control over the kids.  A 5 year old walked out of the day care center, crossed a very busy street, and went into Hooter's.

When my son attended the YMCA summer program, I had to pay them regardless if he went or not. My ex didn't have to pay medical or daycare, I didn't ask for it as it is hard enough to get child support from him.

I know in my husbands order it had it specify that he ONLY paid for work related childcare (if mom wasn't working he didn't have to pay daycare) My ex paid his portion directly to the daycare provider and not the mother.

Just depends on the order.  I would contact the YMCA and see if they can work with you and ask how they bill.
