SPARC Paternity FAQ

18. My ex had a child with her boyfriend after she separated. No father is listed on the birth certificate. My ex says that paternity for this child shouldn't be included in the divorce. What possible legal ramifications could this entail?
A few years down the road she can state you are the dad and sue for support. The support could go as far back as the birth of the child. This would create a legal battle that would be long, hard and very expensive. It is better to force the issue now and pay for a paternity test than to "be the nice guy" and have hell to pay for it later.
