46. My ex has been in the hospital for several weeks and has left my son with her mother. Shouldn't he be staying with me? What are my legal rights?
The child should be staying with you. Your rights, in part, depend upon what is in your parenting plan. If you have a "Right Of First Refusal" provision in the parenting plan, you may need to go to court to enforce it. If you don't have such a provision in your parenting plan, you may want to consider adding one.
